Callmar Terms of Use

Welcome to Callmar. By installing, accessing, or using the Callmar iOS app ("App") you agree to these Terms of Use ("Terms"). If you do not agree, do not install or use the App.

These Terms are between you and Callmar, the app's publisher ("Callmar", "we", "us"). They are entered into in addition to Apple's Standard EULA for Apps, which Apple imposes on every app distributed through the App Store. Where these Terms are silent, Apple's Standard EULA applies.

1. What Callmar is

Callmar is a SIP/VoIP softphone. It connects to SIP accounts you provide and lets you place and receive calls over the internet through CallKit. Callmar is not a telephone carrier and does not provide SIP service itself.

2. Subscription, free trial, and billing

Callmar offers an auto-renewable subscription ("Callmar Pro") with the following terms. The actual price displayed in the App Store at the time of purchase governs your purchase, including any region-specific prices Apple shows in your local currency.

3. What you get with a Callmar Pro subscription

While your subscription is active you can:

If your subscription expires, the app enters read-only mode: you can still view and export your existing call history, transcripts, recordings, and contacts, but cannot place new calls or run new transcription until you resubscribe.

Callmar is not a party to your contract with your SIP provider and cannot mediate disputes between you.

5. Call recording and transcription

Both Save Audio Recordings and Transcribe Calls are disabled by default. Enabling either requires you to acknowledge a legal consent screen inside the App.

You agree not to use Callmar to:

Callmar reserves the right to block accounts on the optional push proxy (sip.callmar.online) that we observe engaging in abusive behaviour. The App itself remains usable in foreground mode for direct SIP connections.

7. Disclaimer of warranty

The App is provided "as is" and "as available" without any warranty of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. Callmar does not warrant that calls will always connect, that the push proxy will be available, that transcription will be accurate, or that the App will be free from errors or interruptions.

8. Limitation of liability

To the maximum extent permitted by applicable law, Callmar's total liability to you for all claims arising out of or relating to the App is limited to the amount you paid Callmar through Apple for the twelve months immediately preceding the claim. Callmar is not liable for indirect, incidental, consequential, or punitive damages.

This limitation does not apply to liability that cannot be limited under your local law (e.g. gross negligence, wilful misconduct, or consumer protection statutes).

9. Changes to these Terms

We may update these Terms when we add new features or when laws require. Material changes are announced in-app and on this page. The "Last updated" date at the top reflects the latest revision. Continuing to use the App after a change means you accept the new Terms; if you disagree, stop using the App.

10. Governing law

These Terms are governed by the laws of the jurisdiction stated in the App Store description's "Seller" field, without regard to its conflict-of-laws principles. Mandatory consumer-protection laws of your country of residence are not affected.
